Comment letter from ACWA to EPA, developed by ACWA’s Waters of the United States Working Group, discussing state perspectives on a potential rulemaking redefining “Waters of the United States” to more closely align with the opinion of Justice Scalia in Rapanos v. United States (2006). The letter was in response to EPA’s request for comment from state partners as part of their federalism consultation and outreach as required under Executive Order 13132.
