Draft FY 2023-2024 NPMG Available for Comment

EPA released the draft FY 2023-2024 National Program Managers Guidance for comment. NPGs are issued by the EPA’s five major national program offices—Air and Radiation; Water; Land and Emergency Management; Chemical Safety and Pollution Prevention; Enforcement and Compliance Assurance—along with the Office of Congressional and Intergovernmental Relations (OCIR) and the Office of International and Tribal Affairs (OITA). These NPGs communicate operational planning priorities, strategies, and key activities for advancing EPA’s Strategic Plan and guide grant work planning with states, tribes, and territories. For the first time, the NPMG includes the draft National Program Guidance for the Office of Environmental Justice (OEJ) and External Civil Rights Compliance Office (ECRCO) to integrate the agency’s FY22-26 strategic plan with programmatic priorities focusing on advancing EJ and civil rights, as well as addressing climate change. Comments on the draft NPMG are due on July 14, 2022.

CWA Sec. 401 Water Quality Certification Improvement Rule

EPA published a proposed rule, CWA Sec. 401 Water Quality Certification Improvement Rule, in the Federal Register this week. The publication starts the 60-day comment process. Comments on the proposal are due August 8, 2022. According to EPA, “the proposed rule would replace and update the existing regulations at 40 CFR 121, to be more consistent with the statutory text of the 1972 CWA and clarify elements of section 401 certification practice that has evolved over the 50 years since the 1971 regulation was promulgated”.

EPA Announces Release of The Universe of Lagoons Report and the Lagoon Inventory Dataset

On June 2, EPA released two documents, the Lagoon Inventory Dataset and The Universe of Lagoons Report. These documents can help identify and prioritize communities, including underserved communities, that potentially need technical and financial assistance to meet Clean Water Act goals. Specifically, the Lagoon Inventory Dataset can be used to help EPA, technical assistance providers, states, and tribes ensure that Bipartisan Infrastructure Law (BIL) investments reach communities with the greatest need. The Lagoon Inventory Dataset contains information on over 4,500 known discharging lagoon wastewater treatment systems with NPDES permits that are publicly or semi-publicly owned in which lagoons serve as the main form of secondary treatment (without more advanced treatment or add-on technologies). The Universe of Lagoons Report describes the methodology used to aggregate state and tribal lagoon wastewater treatment systems in the Lagoon Inventory Dataset. The report includes an analysis of lagoon wastewater treatment system data, including socioeconomic, environmental justice, and compliance data patterns in communities that utilize lagoons based on data gathered in 2020-2021. Save the Date: National Monitoring Conference 2023 | Call for Sessions Extended to June 24

The 13th National Monitoring Conference will occur April 24–28, 2023, likely in Hartford, Connecticut or Virginia Beach, Virginia AND in a limited virtual setting. This hybrid conference provides opportunities for water stakeholders – federal, state, tribal and local water professionals, nonprofits, academia, water consultants and industry, and volunteer and community scientists – to network, develop new skills and partnerships, and exchange information. The National Water Quality Monitoring Council (NWQMC) is requesting session proposals for concurrent sessions that align with the 2023 conference themes. Concurrent session proposals are due June 24, 2022. Following acceptance of Concurrent Session proposals by July 22, 2022, the NWQMC will issue a Call for Abstracts. The Call for Extended Sessions will be issued in mid-June. Selected Concurrent Session Chairs will be asked to develop and facilitate their Concurrent Session

2023 Conference Session Topics May Include:

  • 50 Years After the Clean Water Act and Similar Efforts: a retrospective & prospective – lessons learned in water quality condition, assessment, justice & equity and long-term trend monitoring
  • Climate Change – impacts on hydrology, living resources, water quality and monitoring methods
  • Volunteer and Community-Based Monitoring – volunteer monitoring, school & community groups and watershed associations, data to action, stewardship, increasing diversity & inclusion
  • Justice, Equity, Diversity & Inclusion – incorporating these values into monitoring programs and policies, providing a seat at the table, language access, land acknowledgements, use of gender pronouns, addressing systemic racial inequities
  • Monitoring for Public Health – water supply, recreational and fish and shellfish consumption, urban water quality
  • Monitoring for Ecological Health – aquatic life uses, biological community health (e.g., macroinvertebrates, fish, diatoms/periphyton), biological index development, eDNA
  • Waterbody Monitoring – lakes, groundwater, estuarine, near-shore ocean, Great Lakes, rivers and streams, wetlands, surface water/groundwater interactions
  • Effectiveness Monitoring – Are Management Actions Working? – restoration results, best management practices, monitoring and education/outreach successes, inform priorities and track progress in protecting and restoring the condition of our nation’s waters
  • Protecting High Quality Waters – monitoring to identify and evaluate waters; inform/implement protection strategies
  • Monitoring Collaboration – national, tribal, regional, state and local initiatives, partnerships, and councils; inclusive stakeholder identification and engagement; Justice, Equity, Diversity and Inclusion
  • Harmful Algal Blooms (HABs) (freshwater & marine) – monitoring HABs, toxins & related factors; monitoring to support management, prevention & treatment, and bloom triggers
  • Persistent Toxic Contaminants – emerging and bioaccumulative contaminants (e.g., PFAS, mercury, cyanotoxins, Vibrio spp, MRSA)
  • Nutrients – nutrient dynamics, public health and ecological impacts, monitoring and analysis for management support
  • Aggregating, Analyzing, Visualizing & Disseminating data/information – open data science tools and tool development; data portals; data equity; R-Shiny applications, story maps, and dashboards; communicating assessment, condition, and trends to decision makers and public
  • New Technologies – in situ and continuous monitoring sensors, remote sensing, analytical methods, eDNA
  • Monitoring considerations for managing the full water cycle-natural vs. human components of a “One Water” initiative
  • Artificial Intelligence and Machine Learning – applications of AI/ML to monitoring science; emerging approaches and opportunities; ethical use, data-driven decision making; and knowledge transfer across science organizations and stakeholders
  • Sources-Contributions of Point and Nonpoint Pollution – atmospheric deposition and hydrological modification

Please review the Concurrent Session Guidelines for details on the session proposal submission and review process. Instructions for submitting concurrent session proposals are available on the conference website here. Session proposers are expected to participate as a Session Chair or designate another as the Chair. All session proposals MUST be received no later than June 24, 2022. By July 22, 2022, Concurrent Session Chairs will be notified if their proposal has been accepted. All accepted concurrent sessions will be included in the Call for Abstracts.

Association Updates

CWA Anniversary Proclamation Template

As part of the CWA@50th Celebration, we have drafted a template that you can use to request a proclamation from your governors.  The template can be edited as your state sees fit.   If you are successful, in getting a proclamation issued, we would love to receive a picture of it that we can post on our website.  Copies of proclamations can be sent either to Julia Anastasio or Kara McCauley.

Seeking Case Studies to Celebrate the 50th Anniversary of the CWA

ACWA is preparing to celebrate the 50th anniversary of the Clean Water Act later this year and we are seeking case studies from our members.   The goal of the campaign is to highlight the great work the states/interstates have been doing in implementing the CWA.  We will kick off the campaign during the 2022 ACWA Annual Meeting (August 3-5, 2022) at Graceland in Memphis, TN.

The campaign includes several components (social media, Story Map, Etc.)  with the most visible being a Story Map website that will consist of state/interstate stories highlighting how your programs are working to achieve the goals of the CWA. This is the time to celebrate the hard work of you and your staff and toot your own horns.

We would like to have stories from all ACWA members in the Story Map. We have created a simple template for you to use to enter your information. You can use an existing case study that you may have already created for another effort or you can come up with a new story.  You can submit more than one story too!  As the template is updated, our consultant will work to get the stories included in the map.

If you would like to submit a case study, please let Julia Anastasio or Kara McCauley know if you intend to submit a case study by June 1, 2022, and we will provide you with a link to the template. This is the time to show how you have been using the CWA to protect and restore the waters in your state!

2022 ACWA Annual Meeting Registration Open

Registration is now open for the 2022 ACWA Annual Meeting, August 3-5, 2022, at The Guest House at Graceland, Memphis, TN. We are looking forward to gathering face to face for the first time in two years! Join us as we celebrate reconnecting with colleagues and kick off the celebration of the 50th Anniversary of the Clean Water Act.  As part of the celebration, the ACWA Board of Directors has decided that there will be no registration fee for the meeting. 2022 ACWA Annual Meeting Travel Scholarships Available

Asset management is a critical component that helps municipalities streamline their planning, tracking and decision-making for maintaining and operating green infrastructure projects. During this webinar you will learn about how to pull together the right team, gain buy-in, develop an overarching framework and use data systems that streamline the inspection and maintenance of your green infrastructure assets. Three speakers will be presenting on different stages of an asset management journey:

• Heather Himmelberger, P.E., Director of the Southwest Environmental Finance Center, who developed an integrated asset management framework for both green and gray assets that can be used by any community or system;

• Randall Wakumoto, P.E., Storm Water Quality Program Administrator for the City and County of Honolulu, Oahu, Hawaii, who is in the process of standing up the city’s asset management program as well as conducting a gap analysis and aspirations to build a long term plan; and,

  • WaterOperator.org aggregates the best resources on the web for small wastewater and drinking water system operators in a free, user-friendly location. The program is a collaboration between the Rural Community Assistance Partnership (RCAP) and the University of Illinois Urbana-Champaign, with funding from the U. S. Environmental Protection Agency.
  • The EPA Searchable Clearinghouse of Wastewater Technologies (SCOWT) is an information-sharing platform that provides resources related to innovative, alternative, and reuse wastewater technologies. The Clearinghouse includes information for both centralized and decentralized treatment systems, which is separated into two searchable databases featuring resources such as reports, case studies, and webinars, in addition to a map function that allows users to search resources based on geographic location

Webinar participants will learn how to use these two platforms, including how to find helpful resources and learn about upcoming events. There will be Q+A.

EPA to Hold Next NEJAC Public Meeting on June 22-23, 2022

 EPA is holding the next National Environmental Justice Advisory Council (NEJAC) two-day public meeting on June 22-23, 2022 from approximately 1:00-5:00 pm (ET) each day. Individual registration is REQUIRED. This free meeting is open to the public. Members of the public are encouraged to provide comments relevant to the specific issues being considered by the NEJAC.

 Agenda: The primary purpose of this meeting is for the NEJAC to finalize advice and recommendations on EPA’s investments to address environmental justice through the Justice40 Initiative. The meeting agenda and other meeting support materials will be posted in the public docket (Docket ID No. EPA-HQ-OA-2022-0053) as they become available here.

Public Comment Period: The NEJAC is interested in receiving public comments specific to EPA investments and the public’s recommendation as to where investments are made. Registration to speak during the public comment period will close at 11:59 p.m. E.T., June 15, 2022.  Every effort will be made to hear from as many registered public commenters during the time specified on the agenda on June 22, 2022.

Submitting written comments for the record are strongly encouraged. Written comments can be submitted up until July 6, 2022.

 The Pollution Prevention Finance Forum is a series of webinars that explore opportunities and challenges in financing sustainability, with an initial focus on advancing opportunities for small and medium-sized manufacturing businesses. The purpose of the second Forum webinar is to further assess the types of financial tools and models that are or could be made available for pollution prevention (P2) projects and are relevant to small and medium-sized businesses and manufacturers. The third Forum webinar will assess partnership models and explore potential partnership opportunities and distribution networks for P2 projects. P2, also known as source reduction, is any practice that reduces, eliminates, or prevents pollution at its source prior to recycling, treatment, or disposal. More information can be found here.

NASEM Climate Conversations: Water Justice

Join the National Academies of Sciences, Engineering, and Medicine for a conversation about how to ensure all people in the U.S. have access to clean and safe drinking water in a changing climate.

Millions of people in the U.S. currently lack access to clean and safe drinking water, particularly in low-income rural areas and in communities of color. Our changing climate creates additional threats, such as droughts that diminish surface water bodies, algal blooms and salt-water intrusion that contaminate water supplies, and floods that overwhelm water treatment facilities. Join us for a conversation about how policies and infrastructure could help address current disparities in access to water and build resilience to the increasing impacts from climate change. Senior NPDES Permit Writer | Oregon Department of Environmental Quality

Location: Eugene, Salem, or Medford, Oregon (finalist may choose work location)
Closing Date: July 5, 2022

You will develop complex or innovative National Pollutant Discharge Elimination System (NPDES) permits that originate in any part of Oregon. You will solve difficult NPDES permit-related problems, such as developing permitting strategies to implement state water quality standards or evaluating discharges to water-quality limited water bodies. In addition, you will review final permit drafts from statewide permit program staff for consistency and compliance with federal and state requirements, including internal technical and policy directives.

Basin Coordinator | Oregon Department of Environmental Quality

Location: Portland, Oregon
Closing Date: June 22, 2022

You will develop and implement Total Maximum Daily Loads (TMDLs) in Northwest Region. You will provide technical assistance and review for TMDL implementation activities (ex: modification of permits and development of Nonpoint Source Implementation Plans) in basins with TMDLs. You will ensure that Implementation Plans required by the TMDL to be submitted by responsible parties are developed, submitted, and approved in a satisfactory and timely manner, and in accordance with state and federal laws and statutes, administrative rules, and guidelines. In addition, you will develop and/or modify TMDLs or technical reviews for parameters listed on the 303(d) list for waters in the Willamette Valley. Your primary Basin Coordinator responsibilities will focus on the Clackamas, Molalla, and Sandy Basins.

Environmental Compliance Officer | DC Water

Location: Washington, DC

The Environmental Compliance Officer is responsible for providing permit compliance and pretreatment support for the Blue Plains Wastewater Treatment plant; evaluating and improving the effectiveness of industrial user permitting, inspection, sampling, and enforcement procedures, developing and implementing quality control procedures and data management tools; and staying abreast of environmental regulations.  Industrial pretreatment technologies, and pollution prevention practice.
